Inter-Relationships Between Law And Culture - Law - Intellectual Property

Law regulates human behavior, whereas culture is a result of the aggregation of unregulated human behavior. Although seemingly different, these two parallels intersect often. Law demands that it should be studied and practiced by the book and there should be no human element in passing judgments. This is how the story of the interaction between law and culture starts.

There are many sociologists who have studied this relationship. This discipline is commonly known as the sociology of law. Study on the Law-Society relationship was pioneered by Max Weber and mile Durkheim. Jurists, such as Leon Petrazycki, Eugen Ehrlich and Georges Gurvitch, also attempted to develop theories on this relationship between law and society. Law and culture have evolved together as well as independently.

As a society and its culture become increasingly complex, it is observed by eminent sociologist Emile Durkheim that the authorities of civil law gradually encroach on criminal and penal laws. A reflection of culture can be seen in the legal system. Law has been subject to modifications by elements of society and culture, such as:

1. Gender and sexuality

2. Family

3. Violence

4. Progress in science, technology and medicine

5. Migration

Outside the academic world, the area of intersecting areas of interest of law and culture has resulted in widespread curiosity in the working mechanism of the law and the consequences in the event that the gun of law misfires.
